Terms of Service

By accessing or using PeakWave ("the platform"), operated by PeakWave Ltd, you agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use the platform.

These terms apply to all visitors, candidates, and employers who access or use the platform at peakwave.co.

PeakWave is a free online platform that connects seasonal workers ("candidates") with employers in the ski, yacht, and watersports industries. We provide:

• Profile creation and hosting for candidates seeking seasonal work
• A searchable directory of candidate profiles for employers
• In-platform messaging between candidates and employers
• Content and guides related to seasonal work (the Season Edit blog, resort guides, FAQ)
• A referral programme with optional prize draws

PeakWave is not a recruitment agency. We do not employ, vet, or guarantee candidates, nor do we negotiate employment terms on behalf of either party. All hiring decisions and employment arrangements are made directly between candidates and employers.

To use certain features of the platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your password secure and not share it with others
• Notify us immediately at hello@peakwave.co if you suspect unauthorised access to your account
• Accept responsibility for all activity that occurs under your account

You must be at least 16 years old to create an account on PeakWave. By registering, you confirm that you meet this age requirement.

As a candidate, you agree that:

• All information in your profile is truthful and accurate, including your qualifications, experience, and availability
• Your profile photo and video introduction (if provided) are of yourself and do not infringe anyone else's rights
• You will keep your profile up to date, particularly your availability and placement status
• You will respond to messages from employers in a timely and professional manner
• PeakWave is not responsible for any employment arrangement, contract, or outcome that results from connections made through the platform

As an employer, you agree that:

• You are a legitimate business or individual with genuine seasonal vacancies to fill
• You will use candidate profile data only for the purpose of recruitment for seasonal positions
• You will not contact candidates for purposes unrelated to employment (marketing, spam, etc.)
• You will not download, scrape, or bulk-export candidate data from the platform
• You are solely responsible for conducting your own due diligence (references, right-to-work checks, DBS checks) before making hiring decisions
• PeakWave does not guarantee the accuracy of candidate profiles or the suitability of any candidate for a role

The in-platform messaging system is provided for the purpose of discussing seasonal employment opportunities. You agree not to use messaging for:

• Spam, unsolicited marketing, or promotional content
• Harassment, abuse, discrimination, or threatening behaviour
• Sharing illegal content or content that violates these terms
• Attempting to circumvent the platform (e.g. sharing contact details in initial messages to avoid using the platform)

We reserve the right to review messages if reported for abuse and to suspend or terminate accounts that violate these terms.

PeakWave operates a referral programme where users can invite others to join the platform. By participating, you agree that:

• Referrals must be genuine. Creating fake accounts or using automated tools to generate referrals is prohibited
• Prize draws and rewards are at PeakWave's discretion and may be modified or discontinued at any time
• We reserve the right to disqualify referrals that we believe are fraudulent or in bad faith

The PeakWave platform, including its design, code, branding, and content (excluding user-generated content), is owned by PeakWave Ltd and protected by copyright and intellectual property laws.

By uploading content to the platform (profile text, photos, videos), you grant PeakWave a non-exclusive, worldwide, royalty-free licence to display that content on the platform for the purpose of operating the service. You retain all rights to your content, and this licence ends when you remove the content or delete your account.

You agree not to:

• Use the platform for any illegal purpose
• Impersonate another person or create a fake profile
• Attempt to gain unauthorised access to the platform, other accounts, or related systems
• Interfere with or disrupt the platform or its infrastructure
• Use automated tools (bots, scrapers, crawlers) to access the platform without our written permission
• Post content that is defamatory, obscene, discriminatory, or otherwise objectionable

PeakWave is provided "as is" and "as available". To the fullest extent permitted by law:

• We make no warranties or representations about the accuracy, reliability, or availability of the platform
• We are not liable for any employment decisions, disputes, or outcomes arising from connections made through the platform
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform
• Our total liability to you for any claim arising from these terms shall not exceed the amount you have paid us (which, as the platform is free, is zero)

Nothing in these terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

You may delete your account at any time by contacting us at hello@peakwave.co.

We reserve the right to suspend or terminate your account at any time if you violate these terms, without prior notice. Upon termination, your right to use the platform ceases immediately.

We may update these terms from time to time. If we make significant changes, we will notify you via email or a notice on the platform. Your continued use of the platform after changes are posted constitutes acceptance of the revised terms.

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
